Article 1 – Data Controller Identity

Article 2 – Scope

This Privacy Policy applies to all personal data processing carried out by DiscorAds in connection with the operation of the platform accessible at https://discorads.com.

It applies to all Platform Users (Advertisers and Publishers), as defined in the General Terms and Conditions of Use (GTU).

Article 3 – Data Collected

3.1 – Data Provided Directly by the User

DiscorAds collects data provided by the User when creating and using their account, including: identification data (first name, last name, email address, Discord username) for account creation and management; professional data (company name, legal status where applicable) for invoicing and tax compliance purposes; Discord server information (name, topic, member count, tags) for matching Advertisers with Publishers; as well as advertising content (text, visuals, links) submitted by Advertisers for campaign validation and distribution.

3.2 – Automatically Collected Data

The Platform automatically collects certain data during its use, including: connection data (IP address, browser type, operating system) for security and fraud prevention purposes; usage data (pages visited, actions performed) for service improvement and statistics; as well as Campaign performance data (number of clicks, aggregated impressions) for tracking and reporting.

3.3 – Data Collected by Stripe

For payment processing operations, Stripe collects directly from the User the data required to process transactions, including card details, bank account information for payouts to Publishers, and identity verification documents as part of the KYC process.

DiscorAds does not collect, store, or have access to any banking data. Stripe acts as an independent data controller for this data. For more information, please refer to Stripe's privacy policy: https://stripe.com/privacy.

3.4 – Data Not Collected

DiscorAds does not collect any personal data from Discord end users (members of Publishers' servers). Campaign statistics are exclusively aggregated and anonymous.

Article 4 – Legal Bases for Processing

The processing carried out by DiscorAds is based on the following legal grounds as defined under Article 6 of the GDPR:

• Account creation and management, Campaign distribution, and payment processing via Stripe are based on the performance of a contract (GTU/GTC);
• Tax and accounting obligations are based on a legal obligation;
• Fraud prevention, security, and Platform improvement are based on DiscorAds' legitimate interests;
• Commercial communications and non-essential cookies are based on the User's prior consent.

Article 5 – Data Recipients

Personal data may be shared with the following categories of recipients:

• Stripe, payment service provider, for processing financial transactions and identity verification (KYC);
• The Platform's hosting provider, for hosting and technical infrastructure;
• The DiscorAds internal team, for account management, support, and moderation;
• Tax authorities, in compliance with legal obligations (Article 242 bis of the French General Tax Code);
• Competent authorities, in response to judicial or administrative requisitions.

DiscorAds does not sell, rent, or transfer any personal data to third parties for commercial or advertising purposes.

Article 6 – Transfers Outside the EU

Some service providers, including Stripe, may process data outside the European Union. In such cases, DiscorAds ensures that appropriate safeguards are in place in accordance with the GDPR, in particular through standard contractual clauses adopted by the European Commission, European Commission adequacy decisions, or any other transfer mechanism permitted by applicable regulations.

Article 7 – Data Retention Periods

Data is retained for the following periods:

• User account data: duration of the contractual relationship, then 3 years after account deletion;
• Invoicing and transaction data: 10 years, in accordance with accounting and tax obligations;
• Connection data (logs): 12 months, in accordance with applicable regulations;
• Advertising content: duration of the Campaign, then 1 year;
• Aggregated performance data: retained indefinitely, as the data is anonymised.

At the end of these retention periods, data is deleted or irreversibly anonymised.

Article 8 – User Rights

In accordance with Articles 15 to 22 of the GDPR, each User has the following rights:

• Right of access: obtain confirmation that data is being processed and receive a copy;
• Right of rectification: request the correction of inaccurate or incomplete data;
• Right to erasure: request the deletion of data, subject to legal retention obligations;
• Right to restriction: request the restriction of processing in certain cases;
• Right to data portability: receive personal data in a structured, commonly used, and machine-readable format;
• Right to object: object to processing based on legitimate interests;
• Right to withdraw consent: withdraw previously given consent at any time.

8.1 – How to Exercise Your Rights

Any request may be sent by email to [email protected], accompanied by proof of identity where there is reasonable doubt as to the identity of the requester.

DiscorAds undertakes to respond within thirty (30) days of receiving the request. This period may be extended by two months in cases of complexity, in which case the User will be informed.

8.2 – Complaint to the Supervisory Authority

If the response is unsatisfactory or no response is received, the User may lodge a complaint with the relevant data protection authority. In France, this is the Commission Nationale de l'Informatique et des Libertés (CNIL), accessible at https://www.cnil.fr or by post at: CNIL, 3 Place de Fontenoy, TSA 80715, 75334 Paris Cedex 07.

Article 9 – Cookies

9.1 – Essential Cookies

The Platform uses cookies that are strictly necessary for its operation (authentication, session security). These cookies do not require the User's consent.

9.2 – Analytics and Audience Measurement Cookies

The Platform may use cookies for audience measurement and service improvement purposes. These cookies are only placed after the User's consent has been obtained via a consent banner.

9.3 – Cookie Management

Users may at any time manage their cookie preferences via the Platform's consent banner or through their browser settings. Refusing non-essential cookies does not affect access to the Platform's features.

Article 10 – Data Security

DiscorAds implements appropriate technical and organisational measures to protect personal data against unauthorised access, modification, disclosure, or destruction, including: encrypted communications (HTTPS/TLS), restrictive access controls to data, regular security updates, and team awareness of data protection best practices.

Article 11 – Changes to this Privacy Policy

DiscorAds reserves the right to modify this Privacy Policy at any time. Any material changes will be notified to Users by any appropriate means. The date of the last update is indicated at the top of this document.
